Gasification project receives further mild setback
21st December 2009In a not entirely unexpected decision, planning permission was refused by NYCC Planning Committee at its December 15 meeting. The reasons given revolved around the sustainable credentials of the project based on an assertion that BCB had failed to prove the plant could be connected to the National Grid.
Martin Dale, BCB Director commented: βIt is interesting to note that this decision fundamentally acknowledges β by omission β that the plant will have no environmental impact and silences once and for all the spurious scientific claims of the objectors. That now leaves us only a battle to establish the connection to the grid. YEDL have confirmed they can connect us and have the statutory powers to do so. So, I imagine proving this issue through appeal will be simplicity itself. After that, the extended reasons for refusal fall away as the plant is deemed a recovery facility and recovery facilities do not have to comply with the Proximity Principle.β
A further announcement will be made in due course.
EA formally withdraws objection and offers robust support for the gasification project
23 September 2009As anticipated, the Environment Agency has formally withdrawn its objection to the planning application. In a surprisingly robust letter of support for the project, the EA has stated that it considers the project to be appropriate in principle for the location. The letter goes on to stress that its powers as regulator will ensure that the environmental impact is minimal and that technical concerns raised by local objectors will be satisfied within the framework of the Environmental Permit (required before the facility can operate).
In the context of this support and the accompanying set of Condition recommendations (which the company welcomes), it is clear that the fears raised by objectors are wholly unfounded and the company is now very optimistic with regard to its planning application.
